Official Contest Rules (The "Contest Rules")

  1. Sponsor.

    The PILOT THE MECH SUIT CONTEST (the “Contest”) is sponsored by CreationCrate Inc., 320-200 Silver Star Blvd, Scarborough, Ontario, Canada, M1V 5H4 (the “Sponsor”).
  2. Eligibility.

    This Contest is open to legal residents of the United States, the District ofColumbia, and Canada, excluding the Province of Quebec, who are at least 12 years of age atthe time of entry. In the case of individuals between the age of 12 and the age of majority intheir state, province or territory of residence, such individual’s parent(s) or legal guardian(s)must consent to these rules and their child’s entry in the contest. Employees of the Sponsor, itsparent, related and affiliated companies, subsidiaries, departments or agencies, franchisees,suppliers, advertising and promotional agencies, contest administrators, and any other partiesengaged in the development, production or distribution of the Contest materials, and those livingin the same household are not eligible to enter the Contest. By participating in this Contest,entrants, or their parent(s) or legal guardian(s), as applicable, acknowledge compliance with,and agree to be bound by, these Contest Rules. Entrants, or their parent(s) or legal guardian(s),as applicable, who do not comply with any of the Contest Rules are subject to disqualification bythe Sponsor, in its sole discretion.
  3. Contest Dates and Times.

    The Contest begins on on August 1, 2021 at 12:01 a.m. EST and ends on September 15, 2021 at 11:59 a.m. EST (the

    “Contest End Date”

    ) after which time the Contest will be closed and no further entries will be accepted.
  4. How to Enter.

    Entrants, or their parent(s) or legal guardian(s), as applicable, can enter through these methods: one (1) entry for signing up for the Contest with your email on the Sponsor’s website, one (1) entry for sharing the Contest on Facebook, one (1) entry for sharing the Contest on Twitter, two (2) entries for sharing the Contest through Facebook Messenger, two (2) entries for sharing the Contest through WhatsApp, two (2) entries for sharing the Contest through email, five (5) entries for completing the Sponsor’s survey, Three Hundred (300) entries for subscribing to the Sponsor’s Electronic Curriculum (a

    “Subscription”

    ), and Three Hundred (300) entries for pre-ordering the Sponsor’s Mechatronics Curriculum (a

    “Pre-Order”)

    . Limit 614 entries per individual.
  5. NO PURCHASE NECESSARY. To receive Six Hundred (600) entries in the Contest without a Subscription or a Pre-Order, entrants, or their parent(s) or legal guardian(s), as applicable, can send a FREE request (an

    “Alternate Entry Request”

    ) in writing, including his or her first name, last name and email address to: Creation Crate Inc., Mech Suit Contest Alternate Entry Request, 4109 Todd Lane, Austin, Texas, USA 78744. The Alternate Entry Request must be postmarked between August 1, 2021 and September 15, 2021 and received by the Sponsor by the Contest End Date. Upon receipt of an Alternate Entry Request in accordance with these Rules (as determined by the Sponsor in its sole and absolute discretion), an entrant, or their parent(s) or legal guardian(s), as applicable, will receive Six Hundred (600) entries which will be confirmed via an email (to the email address the entrant, or their parent(s) or legal guardian(s), as applicable, provided as part of his or her Alternate Entry Request). The Sponsor takes no responsibility for any lost, stolen, delayed, illegible, damaged, misdirected, improperly accessed, late or destroyed Alternate Entry Requests. Limit of one (1) Alternate Entry Request per envelope with sufficient postage. No mechanical reproductions of requests permitted.

    For this Contest, receipt of an internet entry occurs when the Sponsor’s server records the entry information. All entries must be complete and are subject to verification by the Sponsor, in its sole discretion. Any individual entrant found to be using multiple Facebook, Twitter, WhatsApp or email accounts to enter this Contest will be ineligible to win. Any attempt or suspected attempt to use robotic, automatic, programmed or otherwise illicit means to enter the Contest, or any other methods not authorized by these Contest Rules, for example, but not limited to, creating multiple Facebook, Twitter, WhatsApp and email accounts, identities, or registrations, all in the Sponsor’s sole discretion, shall be deemed as tampering and may disqualify you from entering, participating and/or winning a prize. Entries that contain false or incomplete information are void. Entries that are late, lost, stolen, illegible, contain false information, are damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of the conditions of the Contest Rules are void. Entrants, or their parent(s) or legal guardian(s), as applicable, grant Sponsor a non-exclusive licence to use all entries for any purpose. No correspondence will be entered into except with Selected Entrants, as defined below. Proof of transmission (for example, screenshots or captures) does not constitute proof of entry or receipt of an entry.

  6. Contest Prize.

    There is one main prize package available to be won, which includes:

    • Two round-trip airline tickets to Squamish, British Columbia, Canada (approximate retail value for two round-trip airline tickets from Toronto, ON to Squamish, BC: $1,200)
    • Two night stay in a 4-star hotel in Squamish, British Columbia, Canada (approximate retail value: $$200)
    • Creation Crate Inc. gift card which can be used to purchase projects and/or swag (approximate retail value: $1,000)
    • Two tickets for a tour at the “Mech Ranch” and a lesson for two participants to learn how to pilot the mech suit at the “Mech Ranch” in Squamish, British Columbia, Canada (approximate retail value: $18,000) (collectively, the

      “Main Prize”

      , with an approximate total retail value: $20,400).
  7. There is also one runner-up prize which is a Samsung Galaxy S21 provided by Telus Communications Inc. (with an approximate retail value: $1,400, the

    “Runner-Up Prize”

    and collectively with the Main Prize, the

    "Prizes"

    ).

    The winners, or their parent(s) or legal guardian(s), as applicable, assume any and all liability for any injury or damage caused, or claimed to be caused, by entering, participating in this Contest or the use or redemption of the Prizes. The Prizes must be accepted as awarded and have no cash value. The Prizes or any portion of the Prizes cannot be combined with other discounts, promotions or special offers. The Sponsor reserves the right to substitute an alternate prize of equal or greater value if the advertised Prizes or any portion of the advertised Prizes are unavailable at the time of award.

  8. Odds of Winning.

    The odds of winning depend on the number of eligible entries received before the Contest End Date.
  9. Skill-Testing Question.

    The Selected Entrants, or their parent(s) or legal guardian(s), as applicable, will be required, as a condition of winning a prize, to correctly answer, without assistance of any kind, the Sponsor’s time-limited, mathematical skill-testing question during a pre-arranged telephone call. Without limiting the generality of the forgoing, the Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate based on the circumstances and/or to comply with applicable law.
  10. Winner Selection and Confirmation.

    On September 16, 2021 at 12:01 a.m. EST in Austin, Texas, USA (the

    “Draw Date”

    ) the Sponsor, or an employee, agent or other representative of the Sponsor, will conduct a random draw from all eligible entries received before the Contest End Date and select the potential winners (the

    “Selected Entrants”

    ). The Selected Entrants will be deemed winners if they meet all of the eligibility criteria set out in these Contest Rules. If the Selected Entrants do not meet the eligibility criteria, they will be disqualified and will not receive the Prizes and another entrant will be selected by way of a random draw from the remaining eligible entries. Before being declared a winner, the Selected Entrants, or their parent(s) or legal guardian(s), as applicable, will be required to: (i) correctly answer the Sponsor’s skill-testing question; (ii) sign and return the Sponsor’s Declaration of Eligibility and Liability/Publicity Release form (the

    “Winner Release”

    ); and (iii) comply with all other Contest Rules, all in the sole discretion of the Sponsor. For certainty, the winner of the Main Prize and the winner of the Runner-Up Prize must be a different individual.
  11. The Selected Entrants, or their parent(s) or legal guardian(s), as applicable, will be notified within ten (10) business days of the contest draw and will be contacted through email at the email address provided at the time of entry into the Contest. Up to three (3) attempts will be made to contact the Selected Entrants, or their parent(s) or legal guardian(s), as applicable, within fifteen (15) business days following the draw. A Selected Entrant, or their parent(s) or legal guardian(s), as applicable, that does not or cannot accept a prize may be forfeited and a new Selected Entrant selected by random draw as described above, in the Sponsor’s sole discretion. A signed copy of the Sponsor’s Winner Release must be received by the Sponsor no later than September 30, 2021. The Sponsor is not responsible for the failure for any reason whatsoever of the Selected Entrant, or their parent(s) or legal guardian(s), as applicable, to receive notification or for the Sponsor to receive the Selected Entrant’s, or their parent(s)’ or legal guardian(s)’, as applicable, response.

    If the identity of a Selected Entrant is disputed, the entry will be deemed to have been submitted by the individual assigned to the email address entered at the time of entry (the

    “Authorized Account Holder”

    ). The Selected Entrants, or their parent(s) or legal guardian(s), as applicable, may be required to provide proof that they are the Authorized Account Holder associated with a selected entry.

  12. Release and Indemnification.

    All winners, or their parent(s) or legal guardian(s), as applicable, must sign the Sponsor’s Winner Release to: (i) confirm compliance with all Contest Rules; (ii) agree to accept the Prizes as awarded; (iii) release, discharge and hold harmless the Sponsor, its departments and agencies, parent, related and affiliated companies, subsidiaries, franchisees, advertising and promotional agencies, counsel, marketing partners, Telus Communications Inc., Facebook, Instagram, Twitter, WhatsApp, YouTube/Google, and each of their respective directors, officers, employees, shareholders, successors, sponsors, partners, licensees, subsidiaries, agents, artists, advisors, assignees, and all others associated with the administration, development and execution of the Contest (the

    “Released Parties”

    ) from and against any and all manner of action, cause of action, claim or demand, loss or injury, use or misuse of the Prizes or any travel related thereto, and the use of entries by the Sponsor, suit, debt, covenant, contract, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach, failure of any third-party contractor or supplier used in connection with any aspect of the Contest to perform or deliver any goods or services, any act of God or any other event beyond the Released Parties’ control, any dissatisfaction of any kind by a winner, or their parent(s) or legal guardian(s), as applicable, with any aspect of the Contest or the Prizes, liability for physical injury, death, or property damage which the entrants, or their parent(s) or legal guardian(s), as applicable, their guests, heirs, executors, administrators, successors or assigns, or other third parties have, might have or could have suffered, by reason of or arising out of the entrant’s, or their parent(s)’ or legal guardian(s)’, as applicable, participation in the Contest and/or in connection with the acceptance and/or exercise by the entrant, or their parent(s) or legal guardian(s), as applicable, of the Prizes as awarded; and (iv) indemnify the Released Parties against any loss, damage or expense, including legal fees, that any of the Released Parties may suffer or incur as a result of any non-compliance by entrants or their parent(s) or legal guardian(s), as applicable, with any of the Contest Rules or participation in the Contest and/or in connection with the acceptance and/or exercise by an entrant, or their parent(s) or legal guardian(s), as applicable, of the Prizes, the use of entries by the Sponsor, misuse of the Prizes or any portion of it, or any travel related thereto.
  13. The Sponsor is not responsible for: (i) incorrect or inaccurate entry information that may affect a person’s ability to participate in the Contest or be awarded a prize, including but not limited to human error, technical malfunctions, lost or delayed entries for any reason, electronic or physical mail failures, omission, or any combination thereof, and entries that fail to fully comply with these Contest Rules; (ii) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (iii) lost, incomplete, delayed, mutilated or misdirected entries or Winner Releases; (iv) injury or damage to entrants’, or their parent(s)’ or legal guardian(s)’, as applicable, computers or to any other individual’s computer related to or resulting from participating in, or downloading any material regarding the Contest or accepting a prize; (v) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s, or their parent(s)’ or legal guardian(s)’, as applicable, participation in the Contest or receipt or use or misuse of the Prizes, including any related travel and the use of entries by Sponsor; (vi) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third-party computer hackers or otherwise; or (vii) late, lost, misdirected or unsuccessful efforts to notify a potential winner.

  14. Other Conditions.

    The Sponsor reserves the right to terminate or amend this Contest at any time and in any way, without prior notice to entrants, or their parent(s) or legal guardian(s), as applicable. Without limiting the foregoing, if, for any reason, the Contest is not capable of running as originally planned for any reason, the Sponsor reserves the right to terminate the Contest and conduct a random draw from all previously received eligible entries received by the Contest End Date.
  15. Publicity and Entrant Information.

    With the exception of any Personal Information of entrant, and/or their parent(s) or legal guardian(s), as applicable, which is subject to applicable privacy laws, by participating in the Contest, entrants, or their parent(s) or legal guardian(s), as applicable, consent to the use of the entrant’s name, address, email address, postal code, telephone number, social media handle(s), comments and image or other likeness, whether on videotape, or via photograph or any other means, for the administration of the Contest or any publicity carried out by the Sponsor, (and any co-sponsors, including Telus Communications Inc.) and their respective parent and affiliate companies, and each of their agents and representatives, and marketing partners, without further notice or compensation.
  16. Law.

    The Contest is void where prohibited by law and is subject to all applicable Canadian federal, provincial, territorial, municipal and local laws. This Contest shall be governed exclusively by the laws of the Province of Ontario, Canada, including all issues and questions concerning the construction, validity, interpretation and enforceability of these Contest Rules, rights and obligations between entrants, or their parent(s) or legal guardian(s), as applicable, and the Sponsor, and procedural provisions, without giving effect to any choice of law or conflict of law rules. Any dispute shall be adjudicated by the courts sitting in Toronto, Ontario, Canada.
  17. Rule Amendments.

    The Sponsor reserves the right, in its sole discretion, to amend or modify these Contest Rules, or modify, cancel or suspend this Contest, without prior notice for any reason whatsoever, including without limitation in the event that any cause beyond the reasonable control of the Sponsor corrupts, or threatens to corrupt, the security or proper administration of the Contest.
  18. Intellectual Property.

    All intellectual property, including but not limited to trademarks, logos, designs, promotional materials, web pages, source codes, images, drawings, illustrations, slogans and representations are owned by the Sponsor. All rights reserved. Unauthorized copying or use of any of the Sponsor’s intellectual property without the express written consent of the Sponsor is strictly prohibited.
  19. Use of Personal Information.

    By participating in the Contest, each entrant, or their parent(s) or legal guardian(s), as applicable, consents to the Sponsor’s and/or their Contest co-sponsors’, prize or service providers’, and administrators’ collection, use, and disclosure of their name, email, or other electronic address, telephone number(s), town or city, province or territory of residence postal code, or mailing address (

    “Personal Information”

    ) solely for the purpose of administering the Contest, including for prize fulfilment purposes, where applicable. Personal Information will only be used for Contest sponsor(s) marketing purposes with the entrant’s consent.
  20. Not Sponsors.

    The Contest is not sponsored, endorsed, administered by, or associated with Facebook, Instagram, Twitter, WhatsApp or Google/YouTube. Any and all Personal Information provided in this Contest is provided to Sponsor and not to Facebook, Instagram, Twitter, WhatsApp or Google/YouTube.
